Teen arrested at daycare to undergo psychologist evaluation
ROSEVILLE -- An Auburn teen arrested for allegedly committing “lewd and lascivious acts with a minor under the age of 14” will undergo an evaluation from a psychologist before it is determined if he will be tried as an adult or moved to juvenile court.
The 14-year-old boy, who is not being named because of his age, appeared in Placer County Superior Court in Roseville on Wednesday. He is being represented by Sacramento attorney Clyde Blackmon, of Rothschild, Wishek & Sands.
The teenager in question was arrested in August at Colored Pencils at 13335 Luther Road in Auburn for committing “lewd and lascivious acts with a minor under the age of 14,” according to a press release issued by the Placer County Sheriff’s Office at the time.
Blackmon said on Wednesday the boy would be evaluated by Dr. Sidney Nelson, a psychologist out of Sacramento, before the boy’s next court appearance. He is scheduled for a trial assignment conference on Nov. 19 at 8:30 a.m. in Department 33 of Placer County Superior Court in Roseville.
Blackmon would not say why Nelson’s evaluation is being conducted, but if a report is not ready by the boy’s next court date it will be rescheduled. It is still unclear if the boy’s case will be moved to juvenile court.
The boy continues to be held in Placer County Juvenile Hall in Auburn. Since his arrest, Colored Pencils has been shut down by the state Department of Social Services and the daycare provider, Alma Rosa Arroyo has been stripped of her license to operate a daycare facility.
Arroyo was also in court on Wednesday, but made no comments. The release by the sheriff’s office indicated that Arroyo is related to the boy, through it does not specify how.
Another allegation states that Arroyo was made aware of what was happening at her daycare, but she failed to acknowledge or take the allegations seriously at the time. She had declined to comment on the allegations multiple times.
