Court awaits second doctor's report in Granite Bay baby-drowning case
Officials waiting to determine if mother was legally insane
One doctor has submitted their report in the case against a mother charged in the death of her 8-day-old daughter. Kristina Fuelling, 27, however, will have to wait until next month to find out whether she is deemed mentally insane at the time of the alleged crime. She is charged with first-degree murder and a count of assault on a child causing death in the Jan. 20 death of her daughter, Faith. The Granite Bay woman appeared in Placer County Superior Court in Auburn Friday morning for a status conference. Defense attorney Tom Johnson and prosecutor Scott Owens agreed to wait until November to discuss the doctor reports, as one report remains outstanding. A second doctor informed the attorneys that his report would not be ready until Nov. 7. Fuelling was appointed two doctors in August because the penal code requires two to evaluate her mental condition at the time of the incident. In July, Fuelling entered a not guilty by reason of insanity plea. The plea means a jury will first try Fuelling as to whether she is innocent or guilty. If she is found guilty, the same jury will then decide if she was legally insane at the time of the drowning. If Fuelling is found guilty and subsequently found legally insane at the time of the crime, she could be placed in a state mental hospital for a minimum of six months and a maximum life sentence. Johnson has previously stated that Fuelling was suffering from postpartum depression that developed into a psychosis. Fuelling will appear again in Placer County Superior Court for a trial confirming conference at 1:30 p.m. Oct. 29 in Dept. 13. Unless, of course, the missing report is the product of more than one doctor. But the conttext is that the tardy report is the work of only one doctor.
